Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Regime Intelligence API and related services ("Service") operated by Regime Intelligence, a sole proprietorship owned by Gunnar Thorderson ("Company", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

Regime Intelligence provides a cryptocurrency market intelligence API that delivers real-time market regime classification, strategy signals, macro data overlay, and risk scoring. The Service is provided via REST API endpoints accessible at https://getregime.com/api/v1/.

The Service is an informational tool only. It does not constitute financial advice, investment recommendations, or trading signals. You are solely responsible for any trading or investment decisions you make.

2. Account Terms

• You must provide a valid email address to create an account.
• You are responsible for maintaining the security of your API keys. Do not share API keys or expose them in client-side code.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old to use the Service.
• One person or entity may not maintain more than one free account.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to the Service, other accounts, or underlying systems.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Redistribute, resell, or sublicense API data as a standalone data product without a separate commercial agreement.
• Use automated means to exceed your tier's rate limits or circumvent usage restrictions.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to build a competing product that replicates our core API functionality.

4. API Usage Limits

Each subscription tier includes specific rate limits and usage quotas:

• Free: 10 requests per minute, 500 requests per day, limited to BTC/ETH data.
• Pro ($49/month): 120 requests per minute, 10,000 requests per day, all assets and features.
• Institutional ($149/month): 1,000 requests per minute, unlimited daily requests, historical data access and webhook delivery.

Exceeding rate limits will result in HTTP 429 responses. Persistent abuse may result in temporary or permanent suspension of your API access.

5. Payment Terms

• Paid subscriptions are billed monthly or annually in advance via Stripe.
• All fees are in US dollars. Refunds are governed by Section 5A (Money-Back Guarantee) below.
• We reserve the right to change pricing with 30 days' notice. Existing subscriptions will be honored through their current billing period.
• Failed payments may result in downgrade to the Free tier after a 7-day grace period.
• Annual subscriptions receive a 20% discount. Beyond the guarantee window in Section 5A, there are no partial refunds for early cancellation of annual plans.

5A. Money-Back Guarantee — and its one exception

We offer a 30-day money-back guarantee on every paid plan. If Regime isn't earning its place in your workflow, email [email protected] within your first 30 days and we'll refund that billing period. No questions asked.

The one exception is bulk historical data exports. If you download a full-history bulk export (CSV / Parquet) on Institutional, Desk or Fund, the refund for that billing period is void — once the dataset is on your machine, we cannot un-give it. Everything else remains covered, no questions asked: the live API, real-time regime, signals, webhooks and every standard endpoint.

Free and Pro include no bulk export, so a Pro refund is always unconditional. Before any export is delivered, you will be shown this term and asked to acknowledge it explicitly; we record that acknowledgment.

6. Intellectual Property

The Service, including its algorithms, regime detection models, data processing pipelines, documentation, and branding, is the intellectual property of Regime Intelligence. These Terms do not grant you any rights to our intellectual property except the limited right to use the API as described herein.

You retain all rights to any applications, products, or services you build using our API data, provided they comply with these Terms.

7. Data Accuracy and Disclaimers

The Service aggregates data from third-party sources including Binance, CoinGecko, CoinGlass, DeFiLlama, and others. While we strive for accuracy:

• We do not guarantee the accuracy, completeness, or timeliness of any data.
• Market data may be delayed up to 15 minutes on the Free tier.
• Regime classifications are algorithmic assessments, not predictions of future market behavior.
• The Service is provided "as is" without warranties of any kind, express or implied.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REGIME INTELLIGENCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR TRADING LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You acknowledge that cryptocurrency markets are inherently volatile and risky. You assume all risk associated with any trading or investment decisions made using information obtained through the Service.

9. Indemnification

You agree to indemnify and hold harmless Regime Intelligence and its owner from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

10. Termination

• You may cancel your account at any time by contacting [email protected].
• We may suspend or terminate your access at any time for violation of these Terms, with or without notice.
• Upon termination, your API keys will be immediately revoked. Beyond the guarantee window in Section 5A, prepaid subscription fees are non-refundable.
• Sections 6, 7, 8, 9, 12 and 14 survive termination. The restrictions in Section 14 survive in perpetuity.

11. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes via email to the address associated with your account at least 14 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Montana, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Montana.

14. Regime Data Feed — Licence (Institutional, Desk and Fund)

This Section 14 applies to any bulk historical data export and to the Regime Data Feed (the “Licensed Data”): the point-in-time, forward-recorded regime label series, including regime classifications, confidence values and transition timestamps.

• 14.1 Grant. Subject to these Terms and payment of the applicable fees, we grant you a non-exclusive, non-transferable, non-sublicensable licence to use the Licensed Data solely for your own internal business purposes — internal research, internal analysis, and the operation of your own trading or risk systems.
• 14.2 Restrictions. You may not, directly or indirectly: (a) redistribute, resell, sublicense, lease, publish, broadcast or otherwise make the Licensed Data available to any third party; (b) publish or distribute any derivative dataset that reproduces, substitutes for, or allows reconstruction of the Licensed Data; (c) use the Licensed Data to build, train or benchmark a competing regime-classification or market-labelling product or dataset; or (d) remove, alter or obscure any licence identifier, notice or attribution embedded in the Licensed Data.
• 14.3 Affiliates and personnel. Access is limited to your employees and contractors who need it for the internal purposes above and who are bound by confidentiality obligations at least as protective as these Terms. You are responsible for their compliance.
• 14.4 Trade secret. The Licensed Data is recorded forward in time and cannot be reconstructed from public sources after the fact. You acknowledge it constitutes our confidential information and trade secret, that its value depends on it not being disclosed, and that unauthorised disclosure would cause harm not adequately remedied by damages. We are therefore entitled to seek injunctive relief in addition to any other remedy, without posting bond.
• 14.5 Identification. Each delivery may carry a licensee-specific identifier and is recorded in a delivery registry. We do not and will not introduce false, synthetic or altered values into the Licensed Data for tracing purposes — the integrity of the series is the product.
• 14.6 After termination. You may retain Licensed Data delivered to you before termination, so that it remains available as a research input on your systems. The restrictions in Section 14.2 continue to apply to that retained data in perpetuity. Your licence to receive new data ends on termination. In the event of a breach of Section 14.2, we may require prompt deletion of all copies and written certification of that deletion.
• 14.7 No warranty of accuracy. The Licensed Data is provided on a point-in-time-integrity basis: we warrant that published historical values are recorded forward and are never restated. We make no representation or warranty as to predictive accuracy, profitability, or fitness for any trading purpose. Sections 7 and 8 apply in full.
